1. Acceptance of Terms
By downloading, installing, or using the Talks application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App after changes constitutes acceptance of the modified Terms.
2. Description of Service
Talks is a private messaging application that allows users to communicate without requiring phone numbers. Our service includes:
- One-on-one private messaging
- Group chat functionality
- End-to-end encrypted communications
- Optional premium features
3. Account Registration
To use Talks, you must:
- Be at least 13 years of age (or the minimum age in your jurisdiction)
- Create an account with a unique username and password
- Provide accurate information during registration
- Maintain the security of your account credentials
You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.
4. Acceptable Use
You agree NOT to use Talks to:
- Violate any applicable laws or regulations
- Harass, bully, threaten, or intimidate other users
- Send spam, unsolicited messages, or advertisements
- Share illegal content, including child exploitation material
- Distribute malware, viruses, or harmful code
- Impersonate others or create fake accounts
- Attempt to hack, reverse engineer, or compromise our systems
- Engage in fraud or deceptive practices
- Violate intellectual property rights of others
- Promote violence, hate speech, or discrimination
We reserve the right to suspend or terminate accounts that violate these terms.
5. Content and Communications
You retain ownership of content you create and share through Talks. By using the App, you grant us a limited license to process and transmit your content as necessary to provide our services.
You are solely responsible for the content you share. We do not monitor private messages due to end-to-end encryption, but we may take action based on reports from other users.
6. Premium Subscriptions
Talks offers optional premium subscriptions with additional features:
Subscription Options
- Monthly Premium: Recurring monthly subscription
- Yearly Premium: Recurring annual subscription at a discounted rate
- Lifetime Premium: One-time purchase for permanent access
Billing
- Subscriptions are billed through Apple App Store or Google Play Store
- Recurring subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- Prices may vary by region and are subject to change
Cancellation and Refunds
- You may cancel subscriptions through your device's app store settings
- Refunds are handled according to Apple App Store or Google Play Store policies
- Lifetime purchases are non-refundable except as required by law
7. Intellectual Property
The Talks app, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the App
- Reverse engineer or decompile the App
- Use our trademarks without permission
- Create derivative works based on the App
8. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- The App will be free from viruses or security vulnerabilities
- The App will meet your specific requirements
- Messages will always be delivered successfully
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of data, profits, or business opportunities
- Damages arising from third-party content or actions
- Service interruptions or data breaches beyond our reasonable control
Our total liability shall not exceed the amount you paid for premium subscriptions in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your content or communications
- Your violation of any third-party rights
- Your violation of applicable laws
12. Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Illegal or harmful activity
- Extended periods of inactivity
- At our discretion with reasonable notice
You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through:
- Informal Resolution: Contact us first to attempt to resolve the dispute informally.
- Arbitration: If informal resolution fails, disputes shall be settled by binding arbitration.
- Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Talks regarding use of the App.
